CONCERNING
THIRTEENTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE No. 89/KMK.04/2002 CONCERNING PROCEDURE FOR THE EXEMPTION OF IMPORT DUTY AND EXCISE ON IMPORTED GOODS FOR THE NEED OF INTERNATIONAL AGENCIES AND THEIR OFFICIALS ASSIGNED IN INDONESIA

Attachment

Considering:

a. that Secretary of the State in letter No. B-6540/Setneg/Setmen/KTLN/04/2010 dated April 16, 2010 proposed international agencies to get exemption from import duty based on Decree of the Minister of Finance No. 89/KMK.04/2002 concerning Procedure for the Exemption of Import Duty and Excise on Imported Goods for the need of International Agencies and Their Officials Assigned in Indonesia as amended several times, the latest by Regulation of the Minister of Finance No. 13/PMK.04/2009;

b. that international agencies are proposed to get exemption of Import Duty as intended in letter of the Secretary of the state as intended in paragraph a, that proposed change several names of international agencies, they are Colombo Plan Australia, Colombo Plan British, Colombo Plan India, Colombo Plan Japan, Technical Cooperation Germany-Republic of Indonesia, Colombo Plan Canada, IPECC (Pakistan-Republic of Indonesia, Colombo Plan New Zealand, PROJECT HOPE (The People Health Foundation, Inc), FPP International (Foster Parents Plan Int.), FADO (Flemish Organization for Assistance on Development), AWB (Asian Wetland Bureau), and CCF (Christian Children’s Fund), and additional proposal of new international agencies, they are JETRO (Japan External Trade Organization) and CWS (Church World Services);

c. that international agencies proposed by Secretary of the State as intended in paragraph b, already fulfill requirements to get exemption of import duty in accordance provision in customs field as intended in paragraph a;

d. that based on consideration as intended in paragraphs a, b and c, it is necessary to stipulate Regulation of the Minister of Finance concerning Thirteenth Amendment to Decree of the Minister of Finance No. 89/KMK.04/2002 concerning Procedure for the Exemption of Import Duty and Excise on Imported Goods for the Need of International Agencies and Their Officials Assigned in Indonesia;

In view of:

1. Law No. 10/1995 concerning Customs (Statute Book of the Republic of Indonesia No. 75/1995, Supplement to Statute Book of the Republic of Indonesia No. 3612) as amended by Law No. 17/2006 (Statute Book of the Republic of Indonesia No. 93/2006, Supplement to Statute Book of the Republic of Indonesia No. 4661);

2. Law No. 11/1995 concerning Customs (Statute Book of the Republic of Indonesia No. 76/1995, Supplement to Statute Book of the Republic of Indonesia No. 3613) as amended by Law No. 39/2007 (Statute Book of the Republic of Indonesia No. 105/2007, Supplement to Statute Book of the Republic of Indonesia No. 4755);

3. Presidential Decree No. 56/P/2010;

4. Regulation of the Minister of Finance No. 89/KMK.04/2002 concerning Procedure for the Exemption of Import Duty and Excise on Imported Goods for the Need of International Agencies and Their Officials Assigned in Indonesia as amended several times, the latest by Regulation of the Minister of Finance No. 13/PMK.04/2009;

DECIDES:

To stipulate:

REGULATION OF THE MINISTER OF FINANCE CONCERNING THIRTEENTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE No. 89/KMK.04/2002 CONCERNING PROCEDURE FOR THE EXEMPTION OF IMPORT DUTY AND EXCISE ON IMPORTED GOODS FOR THE NEED OF INTERNATIONAL AGENCIES AND THEIR OFFICIALS ASSIGNED IN INDONESIA.

Article I

To amend Attachment of Regulation of the Minister of Finance No. 89/KMK.04/2002 concerning Procedure for the Exemption of Import Duty and Excise on Imported Goods for the Need of International Agencies and Their Officials Assigned in Indonesia as amended several times, the latest by Regulation of the Minister of Finance No. 13/PMK.04/2009, become as set out in Attachment of this Regulation of the Minister of Finance that is an integral part of this Regulation of the Minister of Finance.

Article II

This Regulation of the Minister of Finance shall come into force on the date of promulgation.

For public cognizance, this Regulation of the Minister of Finance shall be promulgated by placing it in the State Gazette of the Republic of Indonesia.
